配合紓困特別條例 移工年限屆滿可再申請延長一年

配合紓困特別條例延長施行，勞動部今（31）日發函公告，對於在台累積工作年限屆滿12年或14年的產業或社福移工，聘僱許可如於今(2022)年12月31日前屆滿，雇主可向勞動部申請延長聘僱許可一年。
為減少COVID-19疫情期間人員跨境流動風險，勞動部前依據特別條例第7條規定，經指揮官同意，實施延長移工聘僱許可效期之防疫應變措施，並隨疫情變化多次配合調整。因應立法已通過「嚴重特殊傳染性肺炎防治及紓困振興特別條例」施行期間再延長至明年6月底，勞動部考量現階段國內外疫情狀況、入境檢疫量能及為穩定勞雇關係，對於聘僱許可效期將於2022年12月31日前累計在台工作達就業服務法所訂12年或14年最高年限者，雇主得向勞動部申請再延長聘僱許可效期一年，並持續視疫情發展情勢再做滾動檢討。
勞動部表示，符合上開申請資格者，經勞雇雙方同意，即可由雇主於聘僱許可效期屆滿前後30日內，向勞動部申請再延長一年之聘僱許可。例如：雇主所聘僱的家庭看護工，原聘僱許可將在2022年7月15日屆滿，且屆滿後已達法定在台工作14年上限，經向勞動部申請，可延長聘僱許可至2023年7月15日止。
勞動部統計，自2020年3月至2022年4月止，勞動部累計已核准雇主申請再延長聘僱許可效期計3萬2,861人次；另現行在台將屆滿累積工作年限的移工約3萬5,320人。
