衛生福利部國民健康署針對「菸害防制法」部分條文進行修正，新法今3/22正式上路，修正過的「菸害防制法」，將全面禁止電子煙、納管加熱菸及載具，另外合法的吸菸年齡，今天起提高至20歲。
立法院會今年1月三讀修正通過菸害防制法部分條文，國健署今天將舉行「菸害防制法新法上路，違法產品全面查處」記者會。由於菸害防制法修正案已於上月15日，經總統令修正公布，行政院訂於今天（22日）起施行，即日起，中央與地方針對電子煙、加熱菸違法產品執行查緝專案，將公布周知稽查成果。
國健署指出，這次修法「菸害防制法」7大重點如下：第1、全面禁止電子煙，包括製造、輸入、販賣、供應、展示、廣告及使用。第2、嚴格管制符合菸品定義之新類型菸品（如加熱菸），增訂健康風險評估審查機制，經審查通過，始得製造、輸入。
另外，使用指定菸品時必要之組合元件，須併同送審，管制事項包括如下：禁止以自動販賣、電子購物等無法辨識消費者年齡之方式販賣菸品；禁止菸品特定促銷或廣告行為；營業場所不得免費供應菸品；不得供應菸品予未滿20歲者。
第3、禁止吸菸年齡，提高至未滿20歲。第4、菸品容器警示圖文標示面積增加到50%。第5、禁止使用經中央主管機關公告禁用之添加物。第6、擴大禁菸室內外公共場所。第7、加重罰責。像是全面禁止電子煙部分，違者最高可罰新台幣5千萬。
在罰則方面，若使用電子煙，將處2000元至1萬元罰鍰；供應電子煙及其組合元件，處1萬元至25萬元；販賣、展示電子煙，處20萬至100萬元；業者若製造、輸入、廣告電子煙，處1000萬至5000萬元；業者以外者製造或輸入行為，處5萬元至500萬元罰鍰。
